FlavorBytes - The Foodie Wagon

1. Scope of Application

(1) These Terms and Conditions ("Terms") apply to all contracts between FlavorBytes, trading as "The Foodie Wagon" (the "Provider") and customers (the "Customer") for the supply of food and beverages.

(2) Any deviating terms proposed by the Customer will not apply unless the Provider expressly agrees to them in writing.

(3) These Terms also apply to future business dealings, even if not expressly agreed again at the time.

2. Formation of Contract

(1) An order for food or beverages placed by the Customer at the food truck constitutes a binding offer to enter into a purchase contract.

(2) The contract is formed once the Provider accepts the order. Acceptance may also be implied through the preparation and handover of the food.

(3) For phone or email orders relating to events and catering, the contract is formed upon written or verbal confirmation of the order by the Provider.

3. Prices and Payment

(1) Prices displayed or communicated on the day of ordering apply. All prices are stated in Malaysian Ringgit (RM) and are inclusive of applicable Sales and Service Tax (SST), where relevant.

(2) Payment is generally made in cash or by card at the food truck, including e-wallet and DuitNow payment where available.

(3) For catering orders and events, alternative payment arrangements may be agreed. As a general rule, a deposit of 30% is payable upon confirmation of the order.

(4) The Provider reserves the right to change prices at any time. Contracts already concluded remain unaffected by such changes.

4. Scope of Service and Product Quality

(1) The Provider undertakes to prepare all food fresh and to the best of its knowledge, in compliance with all applicable food safety regulations.

(2) All meat products are 100% Halal. Preparation is carried out in accordance with Halal guidelines and, where applicable, JAKIM certification requirements.

(3) Images and descriptions of food items may differ from the actual product in minor, non-material respects. Slight variations in size, colour, and presentation are possible and do not constitute a defect.

(4) The Provider reserves the right to substitute unavailable ingredients with equivalent alternatives, provided this does not compromise quality.

5. Allergens and Intolerances

(1) Information about allergens and ingredients is available on request. The Customer is responsible for asking about allergens or intolerances before placing an order.

(2) The Provider accepts no liability for allergic reactions where the Customer did not enquire about ingredients before ordering.

(3) Despite taking the greatest care, traces of allergens may be present in the products. Complete avoidance of cross-contamination cannot be guaranteed.

6. Opening Hours and Location

(1) The food truck is regularly open every Saturday at the stated location (Jalan Kenari 5, 47100 Puchong, Selangor) from 11:00 AM to 8:00 PM.

(2) The Provider reserves the right to change opening hours due to weather conditions, events, or operational reasons. Notice will be given in advance where possible.

(3) The Provider is entitled to change location. Any changes will be announced on the website and via social media.

7. Catering and Events

(1) Special arrangements, agreed individually, apply to catering orders and private events.

(2) Catering requests must be submitted at least 7 days in advance. Confirmation will be given after availability has been checked.

(3) No cancellation fee applies if a catering order is cancelled up to 72 hours before the event. For later cancellations, up to 50% of the order value may be charged as a cancellation fee.

(4) The Customer is responsible for ensuring adequate power and water connections, as well as suitable parking space for the food truck, at the event venue.

8. Complaints and Warranty

(1) Complaints must be raised promptly, and no later than 2 hours after the food has been handed over.

(2) Where a complaint is valid, the Provider will, at its discretion, either remedy the issue or refund the purchase price.

(3) Further claims, in particular for damages, are excluded unless the Provider is guilty of intent or gross negligence.

(4) The warranty does not cover defects arising from improper handling or storage after handover.

9. Liability

(1) The Provider's liability is unlimited for damages arising from injury to life, body, or health, and for damages resulting from intentional or grossly negligent breach of duty.

(2) For ordinary negligence, the Provider is only liable in the event of a breach of a material contractual obligation. In such cases, liability is limited to foreseeable damage typical for this type of contract.

(3) Liability under Malaysia's applicable consumer protection legislation, including the Consumer Protection Act 1999, remains unaffected.

(4) Where the Provider's liability is excluded or limited, this also applies to the personal liability of its employees, representatives, and agents.

10. Data Protection

(1) The Provider processes the Customer's personal data for the purpose of performing and fulfilling the contract, in accordance with Malaysia's Personal Data Protection Act 2010 (PDPA).

11. Final Provisions

(1) These Terms are governed by the laws of Malaysia.

(2) Where the Customer is a business, a body corporate, or a statutory body, the courts of Selangor shall have exclusive jurisdiction over any disputes arising from this contract.

(3) Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced with a valid one that most closely reflects the economic purpose of the original provision.
